SALE: TERMS & CONDITIONS

The Terms and Conditions listed below are applicable to all our auctions. Further disclosures will be stated in our advertising as it applies. Registration with Keith Monk Auctions indicates your acceptance of the Terms and Conditions.

1) All persons must register with proper valid identification at Keith Monk Auctions to obtain a bidder number. Bidder numbers must be obtained prior to the start of the bidding process.

2) Keith Monk Auctions reserves the right to refuse registration for the privilege of bidding to any person. A bidder number may also be revoked during the sale due to prior fraudulent activity, impaired state, disrupting the auction.

3) Legal proof of Tax Exemption must be provided prior to registration to obtain a bidder number. Please allow yourself a few extra moments in order to complete the required form.

4) Absentee or telephone bidding is permitted. Bids are accepted and kept confidential. All bids are executed by a designated member of the Keith Monk Auction Team and will be carried out to the best of our ability. We will make every effort to execute the bids in a competitive manner. If you are the successful buyer you will be contacted directly by one of our Team Members and arrangements for payment and pick up shall be made for the same day. In the event of failure to pay, removal or abandonment of any article Keith Monk Auctions reserves the right to reclaim the article for future sale, storage or disposal. The purchaser shall be responsible for all incurred costs associated with the article.

5) Keith Monk Team Members are permitted to bid on articles in the auction and therefore may be bidding for themselves or an absentee person.

6) Any person caught tampering with, moving, or removing items from any ‘lot’ in an auction will be asked to leave the premises and banned for life. Theft will be prosecuted.

7) The Auctioneer reserves the right to withdraw any ‘lot’ from the auction, divide the ‘lot’, or combine a ‘lot’ at their discretion or as necessary up to and including during the auction.

8) Reserved prices are accepted on certain articles, and will be identified as such prior to the sale. Reserve amounts are kept confidential. Real Estate being sold by auction always has a confidential reserve amount.

9) Items shall be sold to the highest bidder acknowledged by the Auctioneer. At this time you must show your bidder number. Once you have shown your number and it has been accepted by the Auctioneer you are accepting responsibility and ownership of the item. Neither Keith Monk Auctions nor its representatives shall be held responsible for lost, stolen or damaged articles, nor hold any liability for the item.

10) We reserve the right to re-auction an article at the auctioneer’s discretion if any dispute arises in relation to the sale of the article between two bidders.

11) All sales are final. Keith Monk Auctions acts as an agent for the consigner. All articles are sold on an ‘as is’, where is’ condition. All articles are sold without warranty or recourse unless otherwise stated. Every effort is made to describe articles accurately, and to the best of our ability, however they are based solely on opinion. Keith Monk Auctions provide preview time prior to the sale starting in order to give bidders ample time to inspect articles carefully.

12) The purchaser assumes responsibility for their articles immediately after purchase. You are responsible for the safe packing, removal and transportation of the articles. This includes shipping, licenses, permits and/or insurance if necessary and all associated costs incurred. If assistance is required by a Keith Monk Team Member they will not be held responsible for any damage, loss or liability.

13) All articles must be paid in full the day of the sale and prior to leaving unless satisfactory arrangements have been made and accepted by all parties involved prior to the sale. In the event of failure to pay, remove or abandonment of any article Keith Monk Auctions reserves the right to reclaim the article for future sale, storage or disposal. The purchaser shall be responsible for all incurred costs associated with the article.

14) There will be a minimal amount of time between your point of purchase and when you are able to check out. You may take your purchases to your vehicle and return. Time to complete paper work and input the sale details are required.

15) All articles purchased must be removed from the auction premises the day of the sale unless prior arrangements have been made and accepted by all parties involved.

16) Any person attending a Keith Monk Auction acknowledges that an auction site is a potentially dangerous place. All persons attending before, during and after the sale are deemed to be there at their own risk. Keith Monk Auctions, Team members and Agents of the sale shall not be held liable for damages, loss, or liability which may occur from any cause whatsoever. Children must be supervised at all times to ensure their safety.

17) Please use discretion when deciding to bring your pet to an auction. If you choose to bring your pet they must be leashed and in your care and control at all times. If a pet is found confined to a vehicle the appropriate actions will be taken to ensure their health and safety. Appropriate agencies will be contacted.
